The conditions for the operation of DBIS are set up in the Act No. 300/2008 Coll., on the electronic acts and authorized document conversion, as amended (the „Act”), which states in Section 14(2) that „The administrator of the information system of data boxes is [Digital and Information Agency]. The operator of the information system of data boxes is the postal license holder”. Article II. Para. 4 of the Act No. 221/2012 Coll., amending Act No 29/2000 Coll., on postal services and amending certain acts (the Postal Services Act), states that „if specific legislation to ensure activities other than the provision of postal services provides that the postal licence holder is an obliged person, this means Czech post, or its legal successor.” Please note that the Ministry of Interior was replaced by the Digital and Information Agency as the administrator of the DBIS with the effect as of 1 April 2023 by the latest amendment of the Act, namely Section XI of Act 471/2022 Coll. Czech Post is thus the only entity authorized to operate DBIS irrespective of its possession of the postal license as of 1 January 2023.
